Kitzmiller et al v. Dover Area School District et al(2005)


1987年の Edwards v. Aguillard裁判 により公立学校の理科の授業に侵入できなくなった創造論者たち。対策として、聖書への直接言及を除去したインテリジェントデザインで再侵入をはかった。2004年末にペンシルバニア州の小さな町Doverの学区教育委員会はインテリジェントデザインを理科のカリキュラムに入れた。これに対して、ACLU(アメリカ自由人権協会)とAU(政教分離のための米国人同盟)の支援のもとで、保護者11名がDover学区を訴えた。そして、原告勝利の判決が2005年12月20日に出た。なお、このときの連邦地裁の裁判官John E. Jones IIIはルーテル教会信者で共和党員。


裁判の概要

In the legal case Kitzmiller v. Dover, tried in 2005 in a Harrisburg, PA, Federal District Court, "intelligent design" was found to be a form of creationism, and therefore, unconstitutional to teach in American public schools.

As the first case to test a school district policy requiring the teaching of "intelligent design," the trial attracted national and international attention. Both plaintiffs and defendants in the case presented expert testimony over six weeks from September 26 through November 4, 2005). On December 20, 2005, Judge John E. Jones issued a sharply-worded ruling in which he held that "intelligent design" was, as the plaintiffs argued, a form of creationism.



裁判の経緯

2004/06
Dover学区は生物の教科書選定を開始。Dover(人口1800)はペンシルバニア中南部州York近くにある。Dover学区には4万人が居住している。Dover高校は1000名の生徒がいる。
2004/08/02|とげとげしい論争の末に、Dover学区教育委員会は5:3で、理科教師ちが推奨し、広く使われているKenneth MillerとJoseph LevineのThe Living Scienceを生物の教科書として採択。

匿名でDover学区にインテリジェントデザイン副読本"Of Pandas and People"が50~60部寄付された。

PHILADELPHIA (Reuters) - A judge on Tuesday barred the teaching of intelligent design as an alternative to evolution at a Pennsylvania school, saying in a scathing rebuke to the school board that it violated a constitutional ban on teaching religion in public schools.
U.S. District Judge John Jones dealt a blow to Christian conservatives, who have been pressing for the teaching of creationism in schools and who played a significant role in the re-election of President George W. Bush.

火曜日に、Pennsylvaniaの学校で、進化論と代替理論としてインテリジェントデザインを教えることを禁じる判決が出た。判決は教育委員会は公立学校で宗教を教えることを禁じた憲法に違反していると強く非難した。
連邦地裁のJohn Jones判事は、学校で創造論を教えることを要求し、ジョージ W. ブッシュ大統領の再選に大きな役割を果たしたキリスト教保守派に打撃を与えた。

The school district was sued by a group of 11 parents who claimed teaching intelligent design was unconstitutional and unscientific and had no place in high school biology class.
In his ruling, the judge suggested the parents file a claim for damages and legal fees against the school district.

学区は、インテリジェントデザインを教えることは憲法違反で、非科学的で、高校の生物授業で教えられるべきでないと主張した11人の親たちのグループに訴えられていた。
判決において、裁判官は両親が学区に対して損害賠償と弁護料を請求するように提案した。

In October 2004, Dover became the first U.S. school district to include intelligent design in science curriculum.
Ninth-grade biology students were presented with a four-paragraph statement saying that evolution is a theory, not a fact, and that there are "gaps" in the theory. The statement invited students to consider other explanations of the origins of life, including intelligent design.

The proper application of both the endorsement and Lemon tests to the facts of this case makes it abundantly clear that the Board’s ID Policy violates the Establishment Clause. In making this determination, we have addressed the seminal question of whether ID is science. We have concluded that it is not, and moreover that ID cannot uncouple itself from its creationist, and thus religious, antecedents.

Both Defendants and many of the leading proponents of ID make a bedrock assumption which is utterly false. Their presupposition is that evolutionary theory is antithetical to a belief in the existence of a supreme being and to religion in general. Repeatedly in this trial, Plaintiffs’ scientific experts testified that the theory of evolution represents good science, is overwhelmingly accepted by the scientific community, and that it in no way conflicts with, nor does it deny, the existence of a divine creator.

被告とIDの指導的支持者の多くは、まったく誤った、根本的仮定を置いている。彼らの前提は進化論が、一般的に至高の存在への信仰と宗教と相容れないというものである。繰り返し本裁判で原告側の科学の専門家が、進化論は良い科学を代表しており、科学界から圧倒的に受け入れられており、創造主の存在と衝突せず、否定もしないと証言している。

To be sure, Darwin’s theory of evolution is imperfect. However, the fact that a scientific theory cannot yet render an explanation on every point should not be used as a pretext to thrust an untestable alternative hypothesis grounded in religion into the science classroom or to misrepresent well-established scientific propositions.

確かに、ダーウィン進化論は完全ではない。しかしながら、科学的理論があらゆる点を説明しきれないていないという事実を、宗教に根ざした証明不可能な代替仮説を理科の授業に持ち込んだり、確立した科学的命題をねじまげる口実として使ってはならない。

まず判決ではインテリジェントデザインが創造論と別物であると認めず、宗教だと判断していること。

さらに、「進化論は神の存在と相容れないものではない」と述べる。これはバチカンの立場「科学者が人間の創造に神の介入を排除しようとせず、信者が聖書の記述の確認を科学に求めようとしなければ、これら2つの人間の起源についての見かたは対立するものではなく、互いに補完しあうものだ。」(エントリ,エントリ)や、「神は自然法則による進化を通じて人間を創造した」という有神論的進化論(エントリ)などの立場にあたる。そして、インテリジェントデザインの主導者たるPhillip Johnsonが「進化論は有神論と相容れない」と語ってきたこと(エントリ)を否定することになる。

そして「ダーウィン進化論は完全ではないから、ID理論」という論理を否定している。この論法は"Argument from ignorance"と呼ばれSkeptic日本版によれば「無知に訴える議論は、論理的に不適切な誤りのひとつである。無知に訴える議論は、これは間違いだと証明されていないから正しい、とか、これは正しいと証明されていないから間違いだ、などと言い出すこと」というもの。UFOから心霊から多くの疑似科学や似非科学で多用される。判決はこの論理を認めないという、至極まっとうなものになっている。


判決への反応

判決への反応を上述のReutersの記事から拾ってみよう。

まずは原告と被告から。

Christy Rehm, one of the plaintiffs, said: "This is a victory for education, a victory for science and a victory for science education."

原告のひとりChristy Rehmは「これは、教育の勝利、科学の勝利と科学教育の勝利です。」とたった。

Richard Thompson, head of the Thomas More Law Center which represented the defendants, said in a statement: "The founders of this country would be astonished at the thought that this simple curriculum change (was) in violation of the constitution that they drafted."

Thomas More法律センターの代表で、被告の代表であるRichard Thompsonは声明で「この国の創設者は、このちょっとしたカリキュラムの変更が、彼らが下書きした憲法違反にされてしまうという考えに驚くでしょう」と語った。

いずれも型どおりのコメントがあるだけ。

ホワイトハウスの反応も、まあそんなところ。
Asked about the ruling, White House spokesman Scott McClellan said the president has said he believed such decisions should be made by local school districts.
"The president has also said that he believes students ought to be exposed to different theories and ideas so that they can fully understand what the debate is about," he said.

判決について質問された、ホワイトハウスのスポークスマンScott McClellan は、「大統領はそのような決定は地域の学区でなされなければならない信じていると言った。大統領は、また、学生たちが異なる理論や考えに触れて、何が議論されているか完全に理解できるようになるべきであると言った。」と答えた。


進化論教育を守る側のコメントは以下のように普通のもの。
Eugenie Scott, head of the National Center for Science Education, called the ruling, "a major victory for science education," but said she expected challenges against evolution to continue.

そして、インテリジェントデザイン推進側のコメント:
Casey Luskin of the Discovery Institute, a Seattle-based think-tank that champions intelligent design theory, criticized the ruling. "The judge thinks intelligent design is a supernatural explanation, but it clearly is not. So the entire decision is predicated on a false perception of intelligent design," Luskin said. "This is by no means the end of this issue, legally speaking," said Luskin, adding that the court only has jurisdiction over part of Pennsylvania.

シアトルに本部を置くインテリジェントデザインを擁護するシンクタンクDiscovery InstituteのCasey Luskinは判決を批判した。「裁判官はインテリジェントデザインが超自然的な説明であると考えています。しかし、それは明らかに違います。従って、この判決は、インテリジェントデザインの間違った認識に基づいたものです。法的には、これはこの問題の終わりで決してはありません。」そして、裁判官にはPennsylvaniaの一部に対する司法権があるだけであると付け加えた。

ただし、Dover学区への判決が判例になるため、裁判費用の負担を覚悟せずに、インテリジェントデザインの教育を義務付けるような行為はむつかしくなっている。
