ルイジアナ理科教育州法(2008 Act473)


インテリジェントデザイン違憲後に成立した最初の「科学理論を理解・分析・批判・レビュー」州法で、対象は「進化論・生命の起源・地球温暖化・ヒトクローンを含むが、これらに限らず」である。民主党Ben Nervers州上院議員の提案で、圧倒的多数で州上下両院を通過し、共和党Bobby Jindal州知事が署名して、州法ACT473としてして成立した。

To enact R.S. 17:285.1, relative to curriculum and instruction; to provide relative to the teaching of scientific subjects in public elementary and secondary schools; to promote students' critical thinking skills and open discussion of scientific theories; to provide relative to support and guidance for teachers; to provide relative to textbooks and instructional materials; to provide forrules and regulations; to provide for effectiveness; and to provide for related matters. Be it enacted by the Legislature of Louisiana:


Section 1. R.S. 17:285.1 is hereby enacted to read as follows: §285.1. Science education; development of critical thinking skills

A. This Section shall be known and may be cited as the "Louisiana Science Education Act."

B.(1) The State Board of Elementary and Secondary Education, upon request of a city, parish, or other local public school board, shall allow and assist teachers, principals, and other school administrators to create and foster an environment within public elementary and secondary schools that promotes critical thinking skills, logical analysis, and open and objective discussion of scientific theories being studied including, but not limited to, evolution, the origins of life, global warming, and human cloning.

州初等中等教育委員会は市・郡・学区教育委員会の求めに応じて、教師・校長・その他学校管理者が、進化論・生命の起源・地球温暖化・ヒトクローンを含むが、これらに限らず科学理論についての批判的思考スキルや論理的解析やオープンで客観的な討論を推進する環境を公立小中学校で創り、育むことを許可し、支援しなければならない。

(2) Such assistance shall include support and guidance for teachers regarding effective ways to help students understand, analyze, critique, and objectively review scientific theories being studied, including those enumerated in Paragraph (1) of this Subsection.

そのような支援には、このサブセクションの(1)で列挙したものを含む、学習する科学理論を、生徒たちが理解・分析・批判・客観的レビューするのを助ける効果的な方法について教師の支援・ガイダンスが含まれる。

C. A teacher shall teach the material presented in the standard textbook supplied by the school system and thereafter may use supplemental textbooks and other instructional materials to help students understand, analyze, critique, and review scientific theories in an objective manner, as permitted by the city, parish, or other local public school board unless otherwise prohibited by the State Board of Elementary and Secondary Education.

教師は、学校が供給する標準教科書に提示された教材を教えなければならない。そのあとで、州初等中等教育委員会に禁じられない限り、市・郡・学校教育委員会が許可にしたがい、生徒たちが客観的な方法で、科学理論を理解・分析・批判・レビューするのを助ける副読本や教材を用いても良い。

D. This Section shall not be construed to promote any religious doctrine, promote discrimination for or against a particular set of religious beliefs, or promote discrimination for or against religion or nonreligion.

このセクションは、いかなる宗教教義の宣伝や、特定宗教信条についての優遇あるいは差別の推進、宗教あるいは非宗教について優遇あるいは差別の推進が可能だと解釈してはならない。

E. The State Board of Elementary and Secondary Education and each city, parish, or other local public school board shall adopt and promulgate the rules and regulations necessary to implement the provisions of this Section prior to the beginning of the 2008-2009 school year

州初等中等教育委員会および各市・各郡・学校教育委員会は、2008-2009学校年度の始まりまでに、このセクションの規定を実行するのに必要なルールや規制を採択・公表しなければならない。

Section 2. This Act shall become effective upon signature by the governor or, if not signed by the governor, upon expiration of the time for billsto become law withoutsignature by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If vetoed by the governor and subsequently approved by the legislature, this Act shall become effective on the day following such approval.
