AN ACT to amend Tennessee Code Annotated, Title 49, Chapter 6, Part 10, relative to teaching scientific subjects in elementary schools.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:

SECTION 1. Tennessee Code Annotated, Title 49, Chapter 6, Part 10, is amended by adding the following as a new, appropriately designated section:

(a) The general assembly finds that:

(1) An important purpose of science education is to inform students about scientific evidence and to help students develop critical thinking skills necessary to becoming intelligent, productive, and scientifically informed citizens;

(3) Some teachers may be unsure of the expectations concerning how they should present information on such subjects.

(b) The state board of education, public elementary and secondary school governing authorities, directors of schools, school system administrators, and public elementary and secondary school principals and administrators shall endeavor to create an environment within public elementary and secondary schools that encourages students to explore scientific questions, learn about scientific evidence, develop critical thinking skills, and respond appropriately and respectfully to differences of opinion about controversial issues.

州教育委員会と初等中等学校管理部門と学校責任者と学校制度管理者と初等中等学校長と管理者は、公立初等中等学校において、生徒たちが科学的問いを探求し、科学的証拠について学び、批判的思考スキルを成長させ、論争問題について異なる意見に対して、適切かつ敬を以て対応できるような環境の構築に努めなければならない。

(c) The state board of education, public elementary and secondary school governing authorities, directors of schools, school system administrators, and public elementary and secondary school principals and administrators shall endeavor to assist teachers to find effective ways to present the science curriculum as it addresses scientific controversies. Toward this end, teachers shall be permitted to help students understand, analyze, critique, and review in an objective manner the scientific strengths and scientific weaknesses of existing scientific theories covered in the course being taught.

(d) Neither the state board of education, nor any public elementary or secondary school governing authority, director of schools, school system administrator, or any public elementary or secondary school principal or administrator shall prohibit any teacher in a public school system of this state from helping students understand, analyze, critique, and review in an objective manner the scientific strengths and scientific weaknesses of existing scientific theories covered in the course being taught.

(e) This section only protects the teaching of scientific information, and shall not be construed to promote any religious or non-religious doctrine, promote discrimination for or against a particular set of religious beliefs or non-beliefs, or promote discrimination for or against religion or non-religion.

SECTION 2. By no later than the start of the 2011-2012 school term, the department of education shall notify all directors of schools of the provisions of this act. Each director shall notify all employees within the director's school system of the provisions of this act.

SECTION 3. This act shall take effect upon becoming a law, the public welfare requiring it.

House Bill 368 (PDF), introduced in the Tennessee House of Representatives on February 9, 2011, is the sixth antievolution bill introduced in a state legislature in 2011, and the first introduced in Tennessee since 2007. The bill, if enacted, would require state and local educational authorities to "assist teachers to find effective ways to present the science curriculum as it addresses scientific controversies" and permit teachers to "help students understand, analyze, critique, and review in an objective manner the scientific strengths and scientific weaknesses of existing scientific theories covered in the course being taught." The only examples provided of "controversial" theories are "biological evolution, the chemical origins of life, global warming, and human cloning." The sole sponsor of HB 368 is Bill Dunn (R-District 16), who, according to Project Vote Smart, answered yes to the question “Should Tennessee require its public schools to teach evolution as theory rather than scientific fact?” in 1996 - the same year in which the Tennessee legislature considered a bill (SB 3229/HB 2972) that would have provided for the suspension or dismissal of any teacher or administrator who taught evolution as a fact rather than a theory.

Senate Bill 893 (PDF), filed in the Tennessee Senate on February 16, 2011, is the seventh antievolution bill introduced in a state legislature in 2011, and the second introduced in Tennessee. Speaking to reporters later, Watson, who was a biology major in college, said “evolution doesn’t explain everything. Currently evolution is the most legitimate scientific process that we have to explain how the world works around us. But there are competing ideas” such as creationism and intelligent design.

He said ideas don’t necessarily equate to scientific theory and may fall more into areas such as philosophy or religion.

“They may not meet the scientific standard, but if they come up in a science class ... and it’s not listed in the state’s curriculum, a teacher should not be off-putting and say that’s not in the curriculum - if you want to talk about intelligent design you should go down the hall to the religious studies class. Teachers should be able to say, look, there are people who view that as a competing idea.”

But teachers still would have to teach the science curriculum, Watson said.

NASHVILLE - The House voted 70-23 today for a bill backers say shields teachers from being disciplined if they discuss alternatives to evolution and global warming theories with students.

The debate ranged over the scientific method, “intellectual bullies,” hair spray and “Inherit the Wind,” a 1960 movie about the 1925 Scopes Trial in Dayton, Tenn.

Sen. Bo Watson, R-Hixson, told the Senate Education Committee he was putting HB368 into "general sub," which means he is not pushing it forward to a vote. The move came on the last scheduled meeting of the committee for this year.

"Practically speaking, I probably am not going to be able to run the bill this year," he said.

The Senate Education Committee wound up adjourning Wednesday night with some other bills left hanging, raising the possibility of another meeting where Watson could revive the measure.

Senate Bill 893 - nicknamed, along with its counterpart House Bill 368, "the monkey bill" - is back. In April 2011, its sponsor Bo Watson (R-District 11), assigned the bill to the general subcommittee of the Senate Education Committee, in effect shelving it for the remainder of the year. But on March 7, 2012, it was revived and placed on the committee's calendar; on March 14, 2012, the committee voted 7-1 (with one member abstaining) to pass an amended version of the bill, although the exact wording of the amended version is not yet listed on the legislature's website. The bill now proceeds to the Senate Select Committee on Calendar for scheduling for a floor vote.

House Bill 368 passed the Tennessee House of Representatives on a 72-23 vote on March 26, 2012, the Chattanooga Times Free Press (March 26, 2012) reports. The bill would encourage teachers to present the "scientific strengths and scientific weaknesses" of topics that arouse "debate and disputation" such as "biological evolution, the chemical origins of life, global warming, and human cloning"; it now proceeds to Governor Bill Haslam, who will have ten days to sign the bill, allow it to become law without his signature, or veto it. Haslam previously indicated that he would discuss the bill with the state board of education, telling the Nashville Tennesseean (March 19, 2012), "It is a fair question what the General Assembly's role is ... That's why we have a state board of education."

Gov. Bill Haslam has declined to sign Tennessee's so-called evolution bill, which protects teachers who criticize evolution, global warming and other scientific theories.

The Republican governor did not veto the measure or sign it, but instead let it become law without his signature. He said earlier that he would probably sign it.

Haslam released this statement today: (本日のHaslam州知事の声明)

“I have reviewed the final language of HB 368/SB 893 and assessed the legislation’s impact. I have also evaluated the concerns that have been raised by the bill. I do not believe that this legislation changes the scientific standards that are taught in our schools or the curriculum that is used by our teachers. However, I also don’t believe that it accomplishes anything that isn’t already acceptable in our schools.

“The bill received strong bipartisan support, passing the House and Senate by a three-to-one margin, but good legislation should bring clarity and not confusion. My concern is that this bill has not met this objective. For that reason, I will not sign the bill but will allow it to become law without my signature.”

既に弱められていたテネシー州の進化論教育


“We don’t even call it evolution. We call it genetic change,” said Donna Sellers, lead teacher in the math, technology and science academy at Central High School. “Evolution is when a bacteria becomes resistant to an antibiotic. It’s how the woolly mammoth became extinct and how the horses used to be smaller. It’s sub-breeds of dogs. It has nothing to do with whether man was once a monkey.”

“I am a Christian ... but our job as teachers is to present the side of science, not to discredit what [students] learn at home or at church.”

According to a Penn State survey last year of 926 public high school biology instructors, the majority of those teachers were not strong advocates of evolutionary biology.

Twenty-eight percent of teachers said they consistently introduce evidence that evolution occurred and create lesson plans that use evolution as a unifying theme for the biology course.

Another 13 percent of biology teachers said they advocate for creationism by spending some class time talking about it in a positive light.

The rest of the study reveals a “cautious 60 percent” of science teachers who wanted to avoid the controversy altogether. They may teach some parts of evolutionary theory while ignoring others.

“Some teachers rationalize the teaching of evolution by referring to high-stakes examinations,” the study stated. “These teachers tell students it does not matter if they really ‘believe’ in evolution, so long as they know it for the test.”
