Institute or Creation Research大学院を学位授与可能とする州法案の登場と廃案
非認証大学院となったICR大学院が学位授与できるようにする州法案がテキサス州下院に登場した(2009/03/09)。しかし、あっさり廃案となり、ICR大学院は非認証のままとなった。

米国の進化論教育を守るNational Center for Science Educationによれば、テキサス州下院に、おそらく"若い地球の創造論"ミニストリInstitute for Creation Researchを特別扱いすることを意図したと思われる州法案HB2800が提案された：
House Bill 2800, introduced in the Texas House of Representatives on March 9, 2009, would, if enacted, in effect exempt institutions such as the Institute for Creation Research's graduate school from Texas's regulations governing degree-granting institutions. The bill's sole sponsor is Leo Berman (R-District 6), a member of the House Higher Education Committee. A member of NCSE called Berman's office to ask whether the bill would apply to the ICR's graduate school; a staffer answered that he thought that it would, adding that he believed that the bill's objective was to aid institutions that want to teach creation science or intelligent design. Berman himself seems not to have offered any public statement about HB 2800 so far.

A BILL TO BE ENTITLED
AN ACT relating to exempting certain private nonprofit educational institutions from state regulation applicable to degree-granting institutions.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter G, Chapter 61, Education Code, is amended by adding Section 61.3031 to read as follows:
Sec. 61.3031. EXEMPTION FOR CERTAIN PRIVATE NONPROFIT EDUCATIONAL INSTITUTIONS.
(a) The provisions of this subchapter do not apply to a private educational institution, including a separate degree-granting program, unit, or school operated by the institution, that:
(1) does not accept state funding of any kind to support its educational programs;
(2) does not accept state-administered federal funding to support its educational programs;
(3) was formed as or is affiliated with or controlled by a nonprofit corporation or nonprofit unincorporated organization; and
(4) offers bona fide degree programs that require students to complete substantive course work in order to receive a degree from the institution.
(b) On the written request of a person acting on behalf of an institution that claims to be exempt from this subchapter as provided by this section, the board may issue a letter certifying a determination by the board that the institution is not subject to regulation under this subchapter.
SECTION 2. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2009.
SUBCHAPTER G. REGULATION OF PRIVATE POSTSECONDARY EDUCATIONAL INSTITUTIONS

Sec 61.3031 特に定める私的非営利教育機関の適用除外
(a) このサブチャプターの条項は、以下に定める私的教育機関および、その教育機関が運営する学位授与プログラムや学科や学部に適用されない：
(1) いかなる教育プログラムにも州の補助金を受けていない。
(2) いかなる教育プログラムにも州が管理する連邦補助金を受けていない。
(3) 非営利法人あるいは非営利の法人ではない団体によって運営されている形で組織されている。
(4) 教育機関から学位を授与されるために、実質的な課程を修了する必要がある本物の学位課程を提供する。
(b) このセクションにより、このサブチャプターの適用除外を、教育機関を代表する人物の文書によって申請された場合、州教育委員会は、当該教育機関がこのサブチャプターの規制を受けない旨を決定した証明書を発行する。
§2 この州法は、テキサス州憲法第III条第39節にしたがい、州上下両院議員の2/3の賛成を以って、ただちに発効する。この州法が即時発行に必要な賛成を得られなかった場合、2009年9月1日に発効する。
この州法案が適用除外にしようとしているサブチャプターGは、学位もどきを規制することを目的としている：
この条項をInstitute for Creation Researchについて適用除外にしようとしたのは、Institute for Creation Researchが運営する理科教育大学院がテキサス州に移転したときに、テキサス州の基準にあわず非認証になっていた。
共和党Leo Berman州下院議員は、これをなんとかしようとしているようである。
テキサス州下院の反進化論州法案HB4224とICR大学院による学位授与をみとめる州法案HB2800が廃案 (2009/06/03)
米国の進化論教育を守るNational Center for Science Educationによれば、2009年6月1日の会期切れで、テキサス州下院の反進化論州法案HB4224と、"若い地球の創造論"ミニストリの非認証大学院による学位授与を認める州法案HB2800が廃案になった：
Two antievolution bills — House Bill 2800 and House Bill 4224 — died when the Texas legislature adjourned on June 1, 2009. HB 2800 would have exempted institutions such as the Institute for Creation Research's graduate school from Texas's regulations governing degree-granting institutions, thus freeing the ICR to offer a master's degree in science education despite the Texas Higher Education Coordination Board's 2008 decision to deny the ICR's request for a state certification of authority to offer the degree. The ICR is currently suing THECB in federal court over its decision. HB 4224 would have required the Texas state board of education to restore the controversial "strengths and weaknesses" language in the Texas state science standards. Although creationists on the board were unsuccessful in restoring the "strengths and weaknesses" language, they successfully introduced a requirement that students examine "all sides of scientific evidence." Partly due to his attempts to undermine the treatment of evolution in the state science standards, the senate voted not to confirm Don McLeroy in his position as chair of the board...
テキサス州下院の会期切れで、2009年6月1日に2つ反進化論州法案HB2800とHB4224が廃案になった。HB2800は、学位授与機関に対するテキサス州の規制からInstitute for Creation Research大学院のような学位授与機関を除外し、2008年にテキサス州高等教育委員会が却下したICR大学院による理科教育修士を、授与可能にするものだった。ICRは現在、テキサス州高等教育委員会を連邦法廷に訴えている。HB4224はテキサス州教育委員会に「[進化論の]強いところと弱いところ」という記述を理科教育標準に復活することを求めるものだった。創造論者たちは「進化論の強いところと弱いところ」という記述の復活に失敗したが、「生徒たちが科学的証拠のあられゆる面を調べる」ことを義務付ける記述の導入に成功している。テキサス州理科教育標準における進化論の扱いを蝕んだ行為も一つの理由となって、Don McLeroy州教育委員長の留任は州上院で承認されなかった。
ということで、共和党Leo Berman州下院議員は敗退した。
